What Is a Plaintiff Class Action?
A class action is a specific type of lawsuit in which a large number of individual plaintiffs file similar or common claims/complaints against the same defendant or defendants.
How Does a Plaintiff Class Action Begin, & How Does it Work?
Specifically, a class action lawsuit begins when one or more of the named plaintiffs file a motion for class certification, and a judge then determines that the plaintiff(s) filing for certification adequately represents the common interests of the entire class of individual plaintiffs.
Typically, in order to receive certification, a proposed class must satisfy the following criteria:
- There are common and clearly similar claims/complaints.
- The class is sufficiently large to render individual lawsuits impracticable.
- The interests of the entire class must be adequately protected by the attorneys designated to represent it.
The designated attorneys represent the entire class, conduct and coordinate the necessary investigations, negotiate settlements, and litigate on the class’s behalf.
Once so certified, a class action lawsuit will be litigated as a single litigation, and before the same judge. All members of the class action lawsuit are treated as unified “class” rather than as individuals.
What Are the Advantages of a Plaintiff Class Action?
In essence, class actions endow individual citizens and everyday people with the ability to take on large and wealthy corporations. They are the means by which an average David can defeat a giant Goliath.
Because class action lawsuits essentially aggregate a large number of similar claims – claims which, if brought individually, and especially against a large corporation, would be both costly in both time and expense to pursue and which, even if successful, might yield little in terms of compensation – they are an efficient and economical way for multiple plaintiffs to hold a defendant accountable, and to seek the legal redress they are due with minimum damage to themselves.
In addition, class action lawsuits relieve plaintiffs of the necessity to pay the upfront and ongoing costs normally associated with individual cases of litigation.
